FLSA Releases Do Not Cover Payroll Periods Prior To, But Not Included In, Release
October 02, 2007
A release of claims under the Fair Labor Standards Act, even issued under the supervision of the Secretary of Labor and on the DOL's approved form, does not serve to release all claims prior to the date of the release. Where the release pertains to specific payroll periods, and the affected employee asserts claims which are earlier than the dates within the scope of the release, those claims may brought in court despite the release and payment of wages for the later period.
